Please note the following regulations from Title 10 Delaware Code, Section 8140, Section 1, Amend Chapter 81 reads as follows ( this is the law as it is written for equestrians protection):

(d)(1) Every equine professional shall post and maintain signs which contain the warning notice specified in paragraph (2) of this subsection. Such signs shall be placed in clearly visible locations on or near stables, corrals or arenas where the equine professional conducts equine activities if such stables, corrals or arenas are owned, managed or controlled by the equine professional. The warning notice specified in paragraph (2) of this section shall appear on the sign in red and white with each letter to be a minimum of 1 inch in height. Every written contract entered into by an equine professional for the providing of professional services, instruction or the rental of equipment or tack or an equine to a participant, whether or not the contract involves equine activities on or off the location or site of the equine professional's business, shall contain in clearly readable print the warning notice specified in paragraph (2) of this subsection.
(2) the signs and contracts described in paragraph (1) of this subsection shall contain the following warning notice:

                                                     WARNING
Under Delaware law, an equine professional is not liable for an injury to or the death of a participant in equine activities resulting from the inherent risks of equine activities, pursuant to 10 Delaware Code subsection 8140. (70 Del. Laws, c.212, subsection 1.)

         RELEASE AND WAIVER OF LIABILITY FOR EQUESTRAIN ACTIVITIES

The Delaware Equine Council (DEC) encourages all individuals who provide equestrian experiences for others to consider adapting and using Release and Waiver of Liability Forms for all individuals, clients, customers, or non-commercial guests who engage in equestrian activities on your property or with your horses.  This is to protect you from financial liability from insurance companies, and implies no ill-will towards your clients or guests.  Regardless of your use of such a form, you are also strongly urged to eliminate all possible negligence in such situations by creating an equestrian environment and experience that is as safe as possible.  For example, always check that tack is secure and properly fitted, ensure a compatible match between horse and rider ability, and remove or identify any physical hazards on your property.  The DEC accepts no liability for your use of such Release and Waiver of Liability Forms.  You are encouraged to seek legal council for your particular needs and questions.
